Gender Pay Equality Law
In May, the Brazil Supreme Court removed attempts to block the new gender pay equality law as unconstitutional. The Labor Ministry now has full powers to enforce the law and impose penalties for non-compliance.
The law requires companies with more than 99 employees to publish salary transparency reports twice each year.
Challenges to the new law had previously been made on grounds freedom of enterprise and data protection concerns, which had delayed its enforcement. These delays have been removed, and applicable employers must now comply with their reporting obligations.
Health and Safety Rules
A new health and safety rule came into effect on May 26th, 2026.
The rule requires companies to update their mandatory Risk Management Programme. In addition to the physical, chemical, biological, ergonomic and accidental risks, psychosocial risks are now to be included.
In their RMPs, companies must identify possible risks to employees’ mental health, monitor those risks and take steps to mitigate risks associated with mental illnesses. Auditors are likely to check whether the programme has been updated.
However, the authorities recognise this will need some adjustment and are unlikely to impose fines for 90 days from the effective date.
