Mexico: Social Security for Digital Platform Workers
With effect from July 1st 2025, new rules came into force to ensure that workers on digital platforms receive social security benefits.
Registration: Companies which provide digital platform services must register workers who earn at least the general monthly minimum wage, with the Mexican Social Security Institute.
Payment: The platform companies must calculate, withhold and pay employer-employee social security contributions including for sickness and maternity insurance, occupational risk, disability and life insurance as well as contributions to the National Workers’ Housing Fund.
Calculation: Social security contributions are based on the worker’s net monthly income, excluding tips, earned through the platform.
Excluded workers: Independent workers who do not reach the minimum monthly income threshold are not required to be insured, unless they choose to be.
Termination: If a worker ceases activity on the platform for 30 consecutive days, the relationship is considered terminated.
This is a high level general update only. Legal advice should be obtained on specific circumstances.
